Terms of Service

Welcome to Journley, a platform designed to help second language learners engage in daily, well-rounded practice through text/audio journal entries. By accessing or using Journley ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

Definitions

In these Terms,

  • • “Journley,” “we,” “us,” or “our” refers to Journley, LLC, the owner and operator of the Service.
  • • “You” or “your” refers to the individual using the Service, whether as a registered user or visitor.

1. Eligibility

You must be at least 16 years old to use Journley. By using the Service, you represent and warrant that you meet this age requirement.

2. Accounts

You must create an account to use the core features of Journley. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify Journley, LLC of any unauthorized use of your account or any other security breach. We encourage you to use a strong, unique password and to take reasonable precautions to secure your account, including not sharing your credentials with others. Journley, LLC will not be responsible for any loss or damage arising from your failure to comply with these obligations.

3. User Content and Sharing

You are responsible for all content you create, upload, or submit to the platform, including but not limited to text and audio journal entries, images, and any other materials ("User Content"). You agree that your submissions will not infringe upon the intellectual property rights, including copyrights, trademarks, or other proprietary rights, of any third party. You must ensure that your User Content complies with these Terms and does not violate the rights of others or any applicable laws.

By submitting User Content, you represent and warrant that you either own the rights to the content or have the necessary permissions to use and share it on the Service. You agree to indemnify and hold harmless Journley, LLC from any claims, damages, or losses arising out of any alleged infringement of intellectual property rights or other legal violations related to your User Content.

Any information you provide to us is at your own risk of loss. You should not include or share sensitive or personally identifiable information—such as your full name, home address, medical records, or financial data—unless you understand and accept that this content may become visible to others.

You retain ownership of your User Content but grant Journley, LLC a non-exclusive, irrevocable, worldwide, perpetual, unlimited, transferable, sublicensable, fully-paid, and royalty-free right to copy, create derivative works, improve, distribute, publish, remove, retain, add to, and process any information.

Specifically, we may use User Content to train and refine AI systems that help recommend language-learning material and personalize user experiences. Any such use for AI training will only be done on anonymized data to the best of our ability.

We will never sell your User Content or personal information to third parties. You retain the right to request the deletion of your personal information at any time by contacting us at the address listed in our Privacy Policy.

We reserve the right (but are not obligated) to monitor, review, remove, or restrict access to any User Content that we believe violates these Terms or applicable laws.

4. Payments and Subscriptions

The Service is currently free. In the future, we may introduce paid plans or features. Any such changes will be accompanied by updated Terms and appropriate notice to users.

5. Third-Party Services

Journley uses the following third-party services:

  • • Google Cloud Translation API and DeepL Translate API for translations.
  • • Firebase Authentication for account management and security.
  • • Google Cloud Storage (U.S. location) to store audio and image uploads.
  • • Webapp, API, and database are hosted in the United States.

These third parties may process your data as necessary to deliver the functionality of the Service. Please note that the terms and conditions, privacy policies, and data handling practices of these third-party services apply to your use of their services. We encourage you to review the terms and policies of each third-party service provider to understand how they handle your information.

6. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. Journley, LLC does not guarantee that the Service will be error-free or uninterrupted. We are not liable for any indirect, incidental, or consequential damages resulting from your use of the Service.

To the fullest extent permitted by law, you agree that:

  • • Journley, LLC is not responsible for the actions or content of other users.
  • • You use the Service at your own risk and are responsible for the information you choose to share.
7. International Use

Although Journley is based in the United States, we welcome users from around the world. Please be aware that your data will be processed in and subject to the laws of the United States. By using Journley, you consent to this processing.

8. Governing Law

These Terms shall be governed by and construed under the laws of the State of Washington, United States, without regard to its conflict of law principles.

9. Termination and Suspension

Journley reserves the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, if we believe you have violated these Terms, misused the platform, or engaged in any activity that may harm the Service, other users, or our reputation.

You may also terminate your account at any time by contacting us at the address provided in Section 13.

10. Changes to the Terms

We may revise these Terms from time to time. If we make material changes, we will provide notice (e.g., by posting a notice on our website or sending you an email). By continuing to use the Service after those changes become effective, you agree to be bound by the updated Terms. If you do not agree to the revised terms, you must stop using the Service.

11. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Journley, LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses—including reasonable legal fees—arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms or applicable law.

12. Feedback

If you choose to submit comments, ideas, suggestions, or other feedback regarding Journley or the Service ("Feedback"), you agree that we are free to use such Feedback without restriction or compensation to you. Feedback will not be treated as confidential.
